Terms & Conditions Of Shipment/ Contract

All payments/deposits made to towards reservations (vehicle bookings) are non-refundable as all spots are reserved an therefore non-refundable. Transit times are estimates only and cannot be guaranteed at any time as they are subject to change due to unforeseen circumstances (i.e. weather conditions, equipment breakdowns/repairs, delays in shipment, equipment availability and others..). Customers are expected to be well behaved with our staff/drivers as we will not tolerate any disrespect and we reserve the right to cancel any shipment due to inappropriate or disrespectful behavior towards its employees. Cancellations under these circumstances may lead to the vehicle being taken to a nearby terminal at the shipper’s expense. All payments made towards shipment reservation are non-refundable and customers cannot make false charge backs to financial institutions. Inoperable Vehicles Additional fees and assistance may be required for loading, unloading and cargo securement costs for all inoperable vehicles. Only for vehicles that are non-running or have trouble to load and unload during shipment. Limitation of Liability We or our agents are not responsible for vandalism, acts of God, or objects flying from the road during transport. Shippers are encouraged to maintain their insurance for these reasons. Vehicle Preparation Shippers are responsible for preparing vehicles for transport. Secure or remove loose parts and accessories. Non-payment for shipment will cost an additional $50 per day per vehicle until the balance is paid in full. Open Lane Auto Transport is not liable for loss or damage to personal items left in the vehicle, damaged tires, undercarriage of the vehicles, aftermarket accessories, low body kits and interior of the vehicle. Third-Party Carriers If Open Lane Auto Transport assigns the order to a third-party carrier, we are not liable for any incidents or damages once the vehicle is in their possession. Also we are not responsible for the delays caused by third parties.  Damage Claims In case of damage, all transport fees must be paid to initiate a claim. Damages should be noted on the bill of lading and signed by both the driver and shipper. Open Lane Auto Transport must be notified of any damages at delivery with a proper description and clear pictures. Jurisdiction Any claims or controversies arising from this agreement are subject to the jurisdiction of the location of Open Lane Auto Transport’s primary office. Our liability is limited to the amount of the deposit on your quotation. Service Changes Open Lane Auto Transport reserves the right to modify any service, content, or features at any time without notice. Non-Disparagement Customers agree to refrain from any actions that might damage the reputation of Open Lane Auto Transport or lead to unwanted or unfavorable publicity. This includes avoiding public criticism or defamatory remarks about Open Lane Auto Transport, its policies, or employees. Confidentiality and Intellectual Property Customers acknowledge that business information, documents, or intellectual property shared during service are confidential and proprietary to Open Lane Auto Transport. Unauthorized use or disclosure of this information is strictly prohibited. Governing Laws These terms and conditions and the use of Open Lane Auto Transport's services are governed by the laws of the province or state where Open Lane Auto Transport is headquartered. We will not be held responsible for the mechanical condition of any vehicle(s) as it is impossible to determine at pick up/delivery at the terminal. Due to many vehicles being shipped in an unrestored and/or vintage condition, We will not be held liable should any part break due to decay or old age / missing parts in transit due to normal wear and tear, rock chips, unclean vehicles. Shipping vintage vehicle(s) may take longer than expected transit times/delays, as they may not be a good fit for each carrier/equipment. Vehicle(s) is/are only insured while on/ in an Auto Carrier. It is the Customer’s responsibility to insure the vehicle(s) while on the ground waiting to be shipped. Exclusion of Wrapped Vehicles from Insurance Coverage  Open Lane Auto Transport's insurance policy does not cover wrapped vehicles. Shippers with wrapped vehicles should obtain additional insurance. Open Lane Auto Transport is not responsible for any damage to the vehicle wrap during transport, including peeling, cracking, fading, or tearing. Local deliveries: Under certain conditions Open Lane Auto Transport reserves the right to drive vehicles to city radius or to nearest Terminal (damage due to rock chips or damage considered as an act of GOD, dust and debris will not be covered). Insurance: Any vehicle that is stored at our storage Facility in any province doesn’t provide insurance(we are not liable),customers must have their own insurance. We are only liable while vehicles are in transit only. It is the client’s responsibility that the vehicle(s) contains suitable antifreeze for a variety of temperatures and that the vehicle(s) is road worthy and safe to operate while in transportation. Emergency brakes must be working for each vehicle. All vehicles must have working emergency brakes. Vehicle(s) with any mechanical issues must be declared when placing an order via email. Failure to declare present issues will result in additional charges being applied to the transportation cost and must be paid before the release of the vehicle (subject to vehicle type). We should be advised if vehicles should be appropriate for weather conditions and fully functional, unless stated as a non-runner vehicle(s). All customers are automatically agreeing to these terms of shipment once they place the order.
